Hello, I’m Alix! I am a photographer based out of Portland, Oregon. I shoot mainly weddings, elopements, photo shoots, and other events, traveling all over the US as well as Nationally for my clients. In my 12 years of experience, I have literally seen it all, and have updated my contract accordingly over the years. Although having a safe/sound contract has always been a huge priority for me, with everything that happened in 2020, I think we all discovered some serious holes in our contracts. I definitely had a couple of freak-out moments. My lawyer and I immediately got together to update my contract, and have turned it into the perfect contract for any pandemic, covering situations I never would have considered before. This contract is designed to keep BOTH you and your clients safe.


The contract is also SO easy to adjust. You’ll need to change a few things like your business name and fees. You’ll receive a PDF that will walk you through exactly which minor adjustments you’ll need to make to make this thing your own.


One of my favorite features of the contract is that it can be used for weddings, events, and photo shoots. You don’t have to use a different contract based on the type of shoot! I love simplicity and cutting down processes to make them easy/efficient.

I searched for a covid friendly contract after realizing that my current contract didn't outline the specifics of a global pandemic. Hiring a lawyer was not an option due to cost, and most of the contracts I found were priced at hundreds of dollars. Thankfully, I found Alix's covid-friendly contract! Covid Related Topics Covered in Contract




Package Adjustments - States that the Client agrees on the event package stated in the Event Schedule, and that they may not reduce coverage. However, they may add coverage. This was a big issue with Covid-19 reschedules.. people wanted to “downgrade” their packages. Although you may choose to allow a client to “downgrade” their package at your discretion, the contract states that you are not liable to do so.




Cancellations - States that all payments received by photographer are non-refundable. If the event is cancelled, the photographer may decide to return any balances at their own discretion, but is not required to return anything.




Substitute Photographer - States that you may send a substitute photographer of similar style at your discretion. If you become sick with Covid-19, any other illness, or are unable to photograph the event, you may send another photographer.




Force Majeure - States that if you are unable to photograph any of the events, or if any of the footage is lost, stolen, or damaged, you will return any balances paid, minus the deposit. Although I would recommend finding another photographer to shoot for you if you are unable to shoot the event



, it’s also important to be fair to your client if you are unable to find someone to send. You would not be liable to return their deposit, but you could make the decision to return the deposit at your own discretion. The contract also states that you won’t be held responsible for any damages to the footage in excess of any amounts paid by the client. It also states that you reserve the right not to shoot in any conditions that would compromise your safety or equipment (i.e. if you find out someone attending the event has Covid, or that they are not taking Covid precautions).




Reserved Dates - Confirms that the deposit and contract will be assigned to the reserved date(s). States that the photographer will not begin any post-production work until paid in full, and that no images will be delivered until you have received the final payment. Specifies an adjustable late fee for late payments, as well as a fee for bounced checks. Also includes an adjustable interest charge on credit card/PayPal payments.




Indemnity and Release of Liability - States that the photographer will not be held liable for any injuries, disease, or illness that occur during the session. Client will indemnify the photographer of any claims relating to injury, disease, or illness. For example, if you were sick and got someone else sick at one of the sessions, or if someone was injured during a session, you will not be held liable.

Copyrights - Gives you full rights to images, and ensures that you can use the images on social media, print, advertising, etc.




RAW Footage - States that RAW images are not included, but that they may be available for purchase at the photographer’s discretion.




Shooting and Editing Style - States that you are hired based on your editing and shooting style, and that you are not to be held liable if the client is unhappy with their photos in any way.




Archiving - States that you, as the photographer, will archive the photos for an adjustable period of time, and that the client must inform you within an adjustable period of time if they want any changes made to the images.




Travel Costs - You’ll clearly state your travel costs, whether included in the price, or additional.




Images Taken - States that unless agreed upon the the event schedule, the photographer does not agree to any other min. number of edited images taken.




Edited Images - States that the photographer will select images to edit at their discretion, and will edit all images they deem important.




Print Release Policy - You will have two options—either give the client full printing rights, or state that they must print the images through you + their online gallery. Gives an adjustable fee for violating.




Social Media - States that the client may share on social media, but may not screenshot or edit the images shared.




Delivery Timeline - States your turnaround time estimate.




Delivery Method - States that you will make the images available through an online proofing gallery that will last x amount of time.




Sole and Exclusive Photographer - States that they may not hire any other photographer for the event.




Limitation of Complaint - States that if the clients has any issues with the delivered product, they must notify you within x amount of time.




Warranty - States that you will not be held liable for any amount that exceeds the sum of the total balance paid by the client. For example, should a legal situation arise, you would never have to pay the client an amount that exceeds the package price.




Entire Agreement - States that this contract is the entire agreement, and that no other oral or other agreements will be valid.




Amendments - Written consent from both parties is required to amend this agreement.




Time is of the Essence - Time matters, so any timelines states must be abided by.




Litigation Expense - Any legal expenses the photographer incurs in defense of legal action or settlement shall be paid by the Client. This basically keeps you safe from any legal fees. If you have to hire a lawyer, the client will need to pay for it.




Survivability - Ensures that the terms in the agreement will always be considered lawful.




Governing Law - Confirms the state in which this contract will be governed. Mine says Oregon.




Survival of Terms - The rites and terms survive, even under termination of agreement.




Joint Preparation - States that the provisions of the document have been negotiated by all parties, and that no party may be discriminated against unfairly or with prejudice.




Joint and Several Liability - Anyone signing this document is held responsible individually.




Modification - States that any provisions must be made in in writing and signed by both parties.
